About This Privacy Policy

Municipal Apparel Company LLC ("MUNICIPAL," "we," "us," or "our") created this Privacy Policy to inform you how we collect, use, share, and treat the personal information we receive from you when you access our website, Municipal.com, and any other related MUNICIPAL links, including any electronic messages between you and our website.

MUNICIPAL receives specific data about its website visitors when the information is provided voluntarily; this includes when you sign up for an account, place an order, or request further services. When website visitors request information, provide information for employment opportunities, or send us an e-mail, we also collect information about the visitor. If you contact us through the website, we will maintain copies of the correspondence. We may also ask for responses to surveys and reviews for research purposes; the information provided to MUNICIPAL will be maintained and possibly shared on our platforms.

Categories of personal information we collect

In the preceding 12 months, we have collected the following categories of personal information, using the categories set out in the California Consumer Privacy Act:

Identifiers — your name, postal address, email address, telephone number, account name, IP address, and unique online identifiers including cookie identifiers and device identifiers.
Personal information described in Civil Code § 1798.80(e) — your name, address, telephone number, and payment card information.
Characteristics of protected classifications — where you provide it to us voluntarily, for example in a survey.
Commercial information — the products and services you have viewed, added to your shopping bag, purchased, returned, or considered, and other purchasing histories or tendencies.
Internet or other electronic network activity information — your browsing history on the Site, your search history on the Site, and information about your interaction with the Site, with our emails, and with our advertisements on other websites and applications.
Geolocation data — approximate location derived from your IP address, at the level of country and region.
Audio, electronic, visual, or similar information — recordings of your interaction with pages of the Site, such as scrolling and clicking, produced by our analytics tools. These recordings mask text you type.
Professional or employment-related information — where you apply for a position with us, or where you seek access to a professional or expert discount program.
Inferences drawn from the above — a profile reflecting your preferences and predispositions, used to personalize the Site and our advertising.

We do not collect biometric information, education information as defined by the Family Educational Rights and Privacy Act, or the contents of your mail, email, or text messages other than messages you send to us.

Why we collect personal information

We collect and use personal information for the following business and commercial purposes:

To provide the Site and our products and services to you, including creating and maintaining your account, processing and fulfilling your orders, processing returns and exchanges, and providing customer service.
To communicate with you about your orders and your account, and, where you have asked us to, to send you marketing email and text messages.

To measure and analyze how the Site is used, to diagnose errors, and to improve the Site's design and performance.
To advertise our products, including cross-context behavioral advertising and targeted advertising, to measure whether our advertising is effective, to limit how often you see the same advertisement, and to attribute a purchase to an affiliate or creator partner who referred you to us.
To detect, investigate, and prevent fraud, abuse, and other unlawful activity, and to protect the security and integrity of the Site.
To conduct surveys, promotions, and contests that you choose to enter.
To comply with our legal obligations, to establish or defend legal claims, and to enforce our terms.

We do not use your personal information for a purpose materially different from these without first providing you notice.

Personal information we sell or share

We disclose personal information to advertising partners so that they can show you advertising that is relevant to you on other websites and applications, and so that we can measure whether our advertising is effective. Under the CCPA and comparable laws in other U.S. states, these disclosures may constitute a "sale" or "sharing" of personal information, or its use for targeted advertising, even though we do not exchange your personal information for money.

Children's Privacy

Protecting the privacy of young children is important to MUNICIPAL. For that reason, MUNICIPAL does not knowingly collect or solicit information from anyone under the age of 13. If you are under the age of 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to MUNICIPAL. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at privacy@municipal.com.

Consumers under 16. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

Our service providers and contractors are permitted to use your personal information only to perform these services for us, and are prohibited by contract from selling or sharing it or from using it for their own purposes. Sensitive personal information

We do not use or disclose sensitive personal information for purposes other than those permitted by the California Consumer Privacy Act and its regulations. We therefore do not offer a separate right to limit the use of sensitive personal information.

Your rights

Depending on where you live, you may have some or all of the following rights. We do not discriminate against you for exercising any of them: we will not deny you goods or services, charge you a different price, or provide you a different level or quality of goods or services because you exercised a privacy right.

The right to know. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting, selling, or sharing it, and the categories of third parties to whom we disclosed it. You may make this request up to twice in a 12-month period.
The right to delete. You may request that we delete personal information we collected from you. Certain information is exempt from deletion — for example, information we need to complete your order, to detect security incidents, or to comply with a legal obligation. When we respond, we will tell you what we kept and why.
The right to correct. You may request that we correct inaccurate personal information we maintain about you.
The right to opt out of the sale or sharing of your personal information, and of its use for targeted advertising. You may exercise this right by selecting Do Not Sell or Share My Personal Information in the footer of any page of the Site, by using an opt-out preference signal as described below, or by writing to us at privacy@municipal.com. You do not need an account and you do not need to verify your identity to opt out.

The right to non-discrimination, as described at the top of this section.
The right to appeal. If you live in a state that provides it and we decline your request, you may appeal our decision by replying to our response or writing to privacy@municipal.com. We will respond to your appeal within the period your state's law allows, and if we deny it we will tell you how to contact your state attorney general.

How to exercise your rights. Write to us at privacy@municipal.com or to MUNICIPAL Apparel Company LLC, Attn: Privacy, 1722 South Coast Hwy, Ste 2, Oceanside, CA 92054. We will verify your identity before responding to a request to know, delete, or correct, using information already associated with your account or order. An authorized agent may submit a request on your behalf by writing to privacy@municipal.com with written permission signed by you; we may ask you to verify your own identity directly.

Residents of U.S. states with comprehensive privacy laws. Residents of California, Colorado, Connecticut, Delaware, Florida, Montana, Oregon, Texas, Utah, Virginia, and other states whose privacy laws provide comparable rights may exercise the rights described above, including the right to opt out of the sale or sharing of personal information and of targeted advertising. The rights available to you, and the deadlines by which we must respond, are set by the law of your state.

Residents of California, additionally. Under California Civil Code §§ 1798.83–1798.84 ("Shine the Light"), you may request information about personal information we disclosed to third parties for their own direct marketing purposes in the preceding calendar year. Write to privacy@municipal.com.

Notice of Right to Opt-Out of Sale/Sharing

You have the right to direct us to stop selling or sharing your personal information, and to stop using it for targeted advertising. To exercise it, select Do Not Sell or Share My Personal Information in the footer of any page of the Site, or select Cookie Settings in the footer and turn off Marketing cookies. Your choice takes effect immediately for the browser and device you are using. If you provide your email address on the opt-out page, we also apply the opt-out to the personal information associated with that address. You do not need to create an account, and we will not ask you to verify your identity, to opt out.

How we handle opt-out preference signals

An opt-out preference signal is a setting you can turn on in some browsers and browser extensions — the best known is Global Privacy Control — that tells every website you visit that you want to opt out of the sale and sharing of your personal information. We honor it.

What the signal applies to. When your browser sends an opt-out preference signal and you are in a U.S. state whose law requires us to recognize it, we treat the signal as a valid request to opt out of the sale and sharing of your personal information and of its use for targeted advertising. We apply it to the browser and device that sent it, immediately and automatically, without any further action from you and without asking you to verify your identity. If you are signed in to an account with us when we receive the signal, or if you give us your email address on our opt-out page, we also apply the opt-out to the personal information associated with that account or address. We do not apply it to purchases you make offline or through any channel other than this Site, because the signal reaches us only through your browser.

Cookies and similar technologies

We use cookies, pixels, and similar technologies on the Site for four purposes: to make the Site work, to measure how it is used, to advertise our products, and to remember your preferences. Our Cookie Policy describes each technology we use, who sets it, what it does, how long it lasts, and how to turn it off — and it governs, in place of this section, with respect to cookies and similar technologies.

You control non-essential cookies through the cookie banner shown on your first visit, and you may change your choice at any time by selecting Cookie Settings in the footer of any page. We do not treat continued browsing, scrolling, or closing the banner as consent.

Shopify's role and where your information is stored

The Site is built on Shopify, a commerce platform operated by Shopify Inc. and its affiliates. Shopify hosts the Site and processes personal information on our behalf as our service provider. Shopify also processes certain information from our store on its own behalf, as an independent controller, to operate, secure, and improve its platform and to provide services to merchants and shoppers across the Shopify ecosystem — including identifying audiences that may be interested in products like ours. That processing is governed by Shopify's own policy rather than by this one.

The information associated with our store is stored in the United States. If you are visiting from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country. Shopify maintains safeguards for such transfers, including the European Commission's standard contractual clauses.

If you are in the European Economic Area, the United Kingdom, or Switzerland, you may exercise your rights in relation to Shopify's own processing, and obtain further information about it, through Shopify's privacy portal at privacy.shopify.com.

If you are in the United States, you may opt out of Shopify's sharing of your personal information and of its use for targeted advertising, in addition to opting out with us, at privacy.shopify.com. Opting out with us through Do Not Sell or Share My Personal Information does not by itself opt you out of Shopify's own processing, and opting out at Shopify does not opt you out of ours. If you want both, use both.

In the European Economic Area, the United Kingdom, and Switzerland, Shopify's processing for these purposes takes place only where you have given consent through our cookie banner.

Email Marketing Program

We respect your privacy. We provide various means to allow you to opt-in to our email marketing newsletter on our website and social media channels to take advantage of new product announcements, exclusive offers, and other subscriber benefits and promotions. You can unsubscribe at any time using the links provided in any marketing email we send you. Emails related to order confirmation, shipment notifications, refunds, or other business-related transactional emails will not be affected by unsubscribing from our marketing emails.

SMS/MMS Mobile Messaging Marketing Program

Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to MUNICIPAL's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of MUNICIPAL through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with MUNICIPAL. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to 1-888-835-1513 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other MUNICIPAL mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Disclosure of Information to Third Parties

Other than what is described in this Privacy Policy, Municipal Apparel Company does not disclose personal information of its users to any outside parties unless permitted or required to do so by law or subpoena. Without limiting the foregoing, we may disclose personal information (a) to conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our Website or our products and promotions; and (c) to exercise or protect the rights, property, or personal safety of the Company, its employees, agents or assigns, or others. Please note that we do not consider "outside parties" our subsidiaries and affiliates, contractors, service providers, and other third parties we use in the operation of our website, conducting MUNICIPAL business, or servicing you, so as long as those parties also agree to keep that information confidential.

In the future, we may buy or sell assets or business offerings from third parties. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer such information in the course of corporate divestitures, mergers, or dissolution.

We do not share credit card information with third parties except for the purpose of processing your order payment and as required by law.

We may make your name and postal address available to other direct marketing companies who may have offers of interest to you.
